MYTICKERSCRIPT LICENSE AGREEMENT

PLEASE READ THESE TERMS CAREFULLY BEFORE YOU INSTALL THE MYTICKERSCRIPT GUIDE ("GUIDE"), BECAUSE BY INSTALLING THE GUIDE YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS GUIDE. BY YOUR ACTION OF USING THIS GUIDE YOU ARE AGREEING TO COMPLY WITH THE TERMS OF THIS AGREEMENT.

1. LICENSE GRANT. MYTICKERSCRIPT grants you a license to use this GUIDE without any payment requirement. "You" means the company, entity or individual whose funds are used to pay the license fee. "Use" means storing, loading, installing, executing or displaying the GUIDE. You may not modify the GUIDE or disable any licensing or control features of the GUIDE except as an intended part of the GUIDE`s programming features.

2. OWNERSHIP. The title, ownership rights and intellectual property rights in and to the GUIDE shall remain with MYTICKERSCRIPT. You agree to abide by the copyright law and all other applicable laws.

3. COPYRIGHT. You acknowledge that no title to the intellectual property in the GUIDE is transferred to you. You further acknowledge that title and full ownership rights to the GUIDE will remain the exclusive property of MYTICKERSCRIPT and you will not acquire any rights to the GUIDE except as expressly set forth in this license. You agree that any copies of the GUIDE will contain the same proprietary notices which appear on and in the GUIDE.

4. REVERSE ENGINEERING. You agree that you will not attempt to reverse compile, modify, translate, or disassemble the GUIDE in whole or in part.

5. WARRANTIES. THE GUIDE IS PROVIDED TO YOU AS IS AND THERE ARE NO WARRANTIES, CLAIMS OR REPRESENTATIONS MADE BY MYTICKERSCRIPT, EITHER EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE GUIDE, INCLUDING WARRANTIES OF QUALITY, PERFORMANCE, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, NOR ARE THERE ANY WARRANTIES CREATED BY COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE. MYTICKERSCRIPT DOES NOT WARRANT THAT THE GUIDE WILL MEET YOUR NEEDS OR BE FREE FROM ERRORS, OR THAT THE OPERATIONS OF THE GUIDE WILL BE UNINTERRUPTED. MYTICKERSCRIPT DOES NOT WARRANT THE ACCURACY OF THE REPORTS GENERATED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION.

6. IN NO EVENT WILL MYTICKERSCRIPT BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOSS OF PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE GUIDE.

7. TERMINATION. This license will terminate automatically if you fail to comply with any term hereof. No notice shall be required from MYTICKERSCRIPT to effect such termination.

9. ENTIRE AGREEMENT. This is the entire agreement between you and MYTICKERSCRIPT which supersedes any prior agreement or understanding, whether written or oral, relating to the subject matter of this license.
