End-User License Agreement (EULA) for Website Ripper Copier
IMPORTANT — READ CAREFULLY: This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Tensons Corporation for the software product identified above, which includes computer software and associated documentation (“SOFTWARE”).
By installing, copying or otherwise using the SOFTWARE you are agreeing to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, then do not install, distribute or use the SOFTWARE.
THIRD PARTY SOFTWARE COMPONENTS
This SOFTWARE incorporates third party software components. All trademarks and copyright are the property of their respective owners. You shall in addition to agree to be bound by the terms and conditions of the software licenses applying to the third party software.
GENERAL
The SOFTWARE is protected by copyright laws and international copyright treaties. The SOFTWARE is licensed, not sold. This EULA gives you the right to use the SOFTWARE, but all rights not specifically mentioned in this agreement, including ownership rights, intellectual property rights, trademarks and copyright, are entirely and exclusively reserved to and by Tensons Corporation.
GRANT OF LICENSE
Trial Version: You are hereby licensed by Tensons Corporation to use this SOFTWARE for evaluation purposes without charge for a period of 30 days. If you use this SOFTWARE after the 30 day evaluation period, you must register this SOFTWARE. Unregistered use of this SOFTWARE after the 30 day evaluation period is in violation of U.S. and international copyright laws.
Registered Version: You may install and use one (1) copy of the SOFTWARE on a single computer. You may also make one (1) copy of the SOFTWARE for backup and archival purposes. You may also store or install a copy of the SOFTWARE on a storage device, such as a network server, used only to install or run the SOFTWARE on your other computers over an internal network; however, you must acquire and dedicate a license for each separate computer on which the SOFTWARE is installed or run from the storage device. A license for the SOFTWARE may not be shared or used concurrently on different computers.
DISTRIBUTION
You may allow other users to evaluate copies of the unregistered SOFTWARE. All evaluation users are subject to the terms of this EULA. The SOFTWARE may be freely distributed, provided that:
1. Such distribution only includes the original archive supplied by Tensons Corporation, taken directly from our web site: http://www.tensons.com/
2. The distribution must not include any registration information.
3. The distribution must explicitly state that this is shareware and that the product is not free.
LIMITATIONS
The SOFTWARE is licensed as a single product. Its component parts may not be separated for use on more than one computer.
You may not reverse engineer, disassemble, or decompile the SOFTWARE except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not create derivative works based upon the SOFTWARE. You may not loan, rent, resell, lease, borrow, sublicense or transfer the use of registered copies of the SOFTWARE.
DISCLAIMER OF WARRANTY
In no event shall Tensons Corporation or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this SOFTWARE, even if Tensons Corporation has been advised of the possibility of such damages.
LINKS TO THIRD PARTY SITES
You may link to third party sites through the use of the SOFTWARE. Tensons Corporation is not responsible for the contents of any third party sites, any links contained in third party sites, or any changes or updates to third party sites.
RESTRICTIONS
The SOFTWARE may be subject to United States Export control. You agree to fully comply with all applicable United States export regulations.
APPLICABLE LAW
The EULA shall be governed by the laws of the State of New York, USA. Exclusive jurisdiction and venue for all matters relating to this EULA shall be in courts and for located in the State of New York, and you consent to such jurisdiction and venue.
TERMINATION
Without prejudice to any other rights, Tensons Corporation may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE.
