BPSNMPMon End user license agreement
Electronic End-user License Agreement (EULA) for FREEWARE
As used in this Agreement, "Author" shall mean Brad Prendergast. This License Agreement is a legal agreement between you (either an individual or a single entity) and the Author for the BPSNMPMon software product, which may include associated software components, media, printed materials, and "online" or electronic documentation ("Software").
FREEWARE LICENSE. This Software is being distributed as Freeware. It may be freely used, copied and distributed as long as it is not sold, and all original files are included, including this license. You are NOT allowed to charge for distributing this Software (either for profit or merely to recover media and distribution costs) whether as a stand-alone product, or as part of a compilation, without explicit prior written permission. You may not rent or lease this software. You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that applicable law notwithstanding this limitation expressly permits such activity.
GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the State of Massachusetts. You consent to the jurisdiction of the state and federal courts located in the State of Massachusetts for all disputes related to this Agreement.
LIMITED WARRANTY AND DISCLAIMER OF WARRANTY.
This Software is supplied "AS IS". The author hereby disclaims all warranties relating to this Software, expressed or implied, including but not limited to damage to hardware, software and/or data from use of this Software. The author does not warrant or make any representations regarding the use or the results of the use of the software provided herewith in terms of correctness, accuracy, reliability, or otherwise. No oral or written information or advice given by the author or an authorized representative shall create a warranty or in any way increase the scope of this warranty. the author hereby disclaims liability for consequential damages. In no event shall the author be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, interruption, loss of information, including property damage, personal injury, intellectual property infringement or any other pecuniary loss) arising out of the use of or inability to use this Software, even if advised of the possibility of such damages.
Due to the nature of evolving programming and the various hardware and software environments in, which this Software may be used, it is understood that occasional "bugs" or unfitness may arise. You should always test this software thoroughly with non-critical data before relying on it.
By installing, copying, or otherwise using this software you acknowledge that you have read the license agreement, understand it, and agree to be bound by its’ terms and conditions.
