END USER LICENSE AGREEMENT CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT. BY OPENING THE PACKAGE OR CLICKING ON THE "YES" BUTTON OR USING THE SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. RecoverPlus and LoaderPlus are Try Before You Buy Software. Refunds are not applicable for Try Before You Buy Software. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, CLICK THE "NO" BUTTON. LICENSE GRANT The license contains software ("Software") and the related explanatory written materials ("Documentation"). "Software" includes any upgrades, modified versions, updates, additions and copies of the Software. "You" means the person or company who is being licensed to use the Software or Documentation. "We" and "us" means Arcksoft and authorized resellers. We hereby grant you a nonexclusive license to use one copy of the Software on any single computer, provided the Software is in use on only one computer at any time. TITLE We remain the owner of all rights, title and interest in the Software and Documentation. ARCHIVAL OR BACKUP COPIES You may make one copy of the Software solely for backup or archival purposes, OR transfer the Software to a single hard disk, provided you keep the original solely for backup or archival purposes. THINGS YOU MAY NOT DO The Software and Documentation are protected by national copyright laws and international treaties. You may not: copy the Documentation, modify or adapt the Software or merge it into another program, copy the Software except to make archival or backup copies as mentioned above, reverse engineer, disassemble, decompile or make any attempt to discover the source code of the Software, place the Software onto a server so that it is accessible via a pubic network such as the Internet, sublicense, rent, lease or lend any portion of the Software or Documentation. TRANSFERS You may not transfer your rights to use the Software and Documentation to another person or legal entity. LIMITED WARRANTY THE NATURE OF DATA AND FILE RECOVERY MEANS THERE ARE NO GUARANTEES. WE DO NOT ACCEPT ANY LIABILITY FOR CONSEQUENTIAL DAMAGES. YOU USE THE SOFTWARE AT YOUR OWN RISK THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OR THAT IT WILL OPERATE UNINTERRUPTED OR ERROR-FREE. In no event we shall be liable for any special, incidental, indirect, punitive, or consequential damages whatsoever, including but not limited to loss of data, business interruption, loss of profits, loss of business information, or any other pecuniary loss, arising out of the use of or inability to use the SOFTWARE. Support for the software is not guaranteed. We make no representation or warranty, and expressly disclaim any liability with respect to the content of the SOFTWARE, including but not limited to errors or omissions contained therein, libel, infringement of rights of publicity, privacy, trademark rights, moral rights, or the disclosure of confidential information. We make no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb or other such computer program. We further expressly disclaim any warranty or representation to you, or to any third party. IN NO EVENT WE WILL BE LIABLE TO YOU FOR MORE THEN THE PRICE PAID FOR THIS LICENSE. CONFIDENTIALITY The Software is being made available to you in strict confidence. ANY USE OR DISCLOSURE OF THE SOFTWARE, OR OF ITS ALGORITHMS, PROTOCOLS OR INTERFACES, OTHER THAN IN STRICT ACCORDANCE WITH THIS LICENSE AGREEMENT, MAY BE ACTIONABLE AS A VIOLATION OF OUR LEGAL RIGHTS. MISCELLANEOUS This Agreement shell be interpreted and construed according to, and governed by, the laws of The Netherlands, whose courts shall have exclusive jurisdiction over all disputes arising in connection with this agreement.
