1.Definitions
1.1 "product" and "products" refer to the WinListMailer-Std 30 day trial version /purchased version of nijasoft WinListMailer-Std.
1.2"Trial version" refers to nijasoft WinListMailer-Std version being downloaded for product assessment / trial.
1.3"purchased version" refers to nijasoft WinListMailer-Std after the expiry of the 30 day trial and the user has purchased it at the prevailing price after satisfying himself/herself about the product in accordance with this license.
2. SCOPE OF LICENSE. nijaSoft.com hereby grants you a non-exclusive, non-transferable license (without the right to sublicense) to use it`s Products in accordance with all of the terms and conditions of this License. You may use the Trial Versionsolely on a trial basis to determine the suitability the product for your needs . You acknowledge that your license to use the Trial version is temporary and that the Trial Version Product is designed to limit both how long you can use it for free and what you can do with it. In particular, the Trial Version Product supplied to you under this License may contain the following features and limitations:
1. Trial Version Products may stop functioning after 30 days.
3.Purchased version
One registered copy of Program may either be used by a single person who uses the software personally on one or more computers, or installed on a single workstation used non simultaneously by multiple people, but not both.
You may access the purchased version of Program through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network. For instance, if 8 different workstations will access Program on the network, each workstation must have its own Program license, regardless of whether they use Program at different times or concurrently.
4.Disclaimer of Warranty
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which Program may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.
Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. The user must assume the entire risk of using the program. ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT .
You may not alter this software in any way, including changing or removing any messages or windows.
Purchased version , however will be entitled to e-mail technical support and free upgrades as described at our website.
5.Limitations of Damages
NIJASOFT.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF NIJASOFT.COM OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
6.Limitations of Liability
NIJASOFT.COM SHALL NOT BE LIABLE FOR ANY PRODUCT MISUSE AND /OR VIOLATION OF ANY ANTI SPAMMING LAWS DUE TO THE USAGE OF IT`S PRODUCTS. CONFORMANCE TO LAWS IN THIS REGARD SHALL BE YOUR RESPONSIBILITY.
7.Security
The program is free from any malware. and will not send any information or data nor run any program other than the program required to perform its essential functions . Please check with any standard anti-virus program for any corruption in downloading.
