PLEASE READ THIS LICENSE AGREEMENT CAREFULLY BEFORE OPENING ANY COMPUTER READABLE MEDIA PACKAGE(S). BY OPENING ANY COMPUTER READABLE MEDIA PACKAGE(S), YOU AGREE TO BECOME BOUND BY THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT, RETURN THIS PACKAGE IN COMPLETE AND GOOD CONDITION TO THE PLACE WHERE YOU PURCHASED IMMEDIATELY AND GET YOUR PAYMENT BACK, UNLESS ANY COMPUTER READABLE MEDIA PACKAGE IS OPENED.
1. Grant of License
The enclosed computer program(s) (The “Software”) is licensed, not sold, to you by Guangzhou YuanFang Computer Software Engineering Co.,Ltd. (“YFCAD”) for use only under the terms and conditions of this License Agreement, and Guangzhou YuanFang Computer Software Engineering Co.,Ltd. reserves any rights not expressly granted to you. You own the compact disk(s) on which the Software is recorded or fixed, but the Software is owned by Guangzhou YuanFang Computer Software Engineering Co.,Ltd. or its suppliers and is protected by the copyright laws of China and international copyright treaty provisions.
The copyright restrictions of this license agreement extend to any further updates, software patches, or bug fixes made available to you by YFCAD, whether distributed on floppy disk, compact disk, or in an electronic format via download, BBS, ftp, e-mail, etc.
This License Agreement allows you to use one copy of the Software on a single computer at a time. To “use” the Software means that the Software is either loaded in the temporary memory (i.e., RAM) of a computer, or installed on the permanent memory of a computer (i.e., hard disk, compact disk, etc.).
You may make one copy of the Software in machine readable form solely for backup purposes. The Software is protected by the copyright law of China. As an express condition of this License Agreement, you must reproduce on the backup copy the Guangzhou YuanFang Computer Software Engineering Co.,Ltd. copyright notice in the following format: ”(C) 2006-2007 Guangzhou YuanFang Computer Software Engineering Co.,Ltd.”
2. Restrictions
The Software contains trade secrets in its human readable form and, to protect them, YOU MAY NOT REVERSE ENGINEER, DECOMPILE, DISASSEMBLE, OR OTHERWISE REDUCE THE SOFTWARE TO ANY HUMAN READABLE FORM. YOU MAY NOT MODIFY, ADAPT, TRANSLATE, RENT, LEASE, LOAN, RESELL
FOR PROFIT, OR CREATE DERIVATIVE WORKS BASED UPON THE SOFTWARE OR ANY PART THEREOF.
3. Termination
This License Agreement is effective until terminated. This License Agreement will terminate immediately without notice from Guangzhou YuanFang Computer Software Engineering Co.,Ltd. or judicial resolution if you fail to comply with any provision of this License Agreement. Upon such termination you must destroy the Software, all accompanying written materials and all copies thereof. You may also terminate this License Agreement at any time by destroying this Software, all accompanying written materials and all copies thereof.
4. Software training, after-sales service and technical support
YFCAD and our resellers provide training for end users. Please contact the place where you purchased the software for training arrangement. 5. Warranty period
If any item (including compact disks, USB key and user manual) in the package is damaged (Excludes damages caused by misuse, accidents or modifications to the product) within 3 months from the date of purchase, please contact the place where you purchased the software for free replacement.
To replace the item (including compact disks, USB key and user manual) which is damaged by misuse, accidents or modifications to the software, additional charge is required.
6.Disclaimer:
The Software, which is a computer-aided design tool, is not a substitution for your professional judgment or substitution for independent testing, product tress, safety, and utility. The Software has not been tested in all situations under which it may be used. YFCAD shall not be liable in any manner whatsoever for the results obtained throughout the use of the Software. Persons using the software are responsible for the supervision, management, and control of the Software. This responsibility includes, but is not limited to, the determination of appropriate used for the Software and the selection of the Software and other programs to achieve intended results. Persons using the Software are also responsible for establishing the adequacy of independent procedures for testing the reliability and accuracy of any program output, including all items designed by using the Software.
7. Limitation of Liability:
In no event will YFCAD be liable for any damages, whether they arise form tort or contract, including loss of data, lost profits, cost of cover, or other special, incidental, consequential, or indirect damages arising out of the use or inability to use the program, however caused and on any theory of liability. This limitation will apply ever if YFCAD or any authorized Dealer or Distributor has been advised of the possibility of such damage. YFCAD reserves the rights to take legal action against any unconformities of this Agreement.
