License Agreement
BY USING THE Ez-ScreenShot SOFWARE OR THE VAPISOFT WEBSITES, YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT AND THE PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE Ez-ScreenShot SOFTWARE, OR WEBSITES.
GENERAL
The Ez-ScreenShot Software ("Software") is provided to you by VapiSoft Ltd. ("VapiSoft") on an "AS IS" basis, for your private personal uses only, without warranty of any kind. By using the Software, you are agreeing to the following License Agreement ("License Agreement").
VapiSoft reserves the rights to modify the License Agreement at any time. New License Agreement will enter into effect 15 days after the day a notice of the availability of new License Agreement will appear on the site, or a new downloadable version of License Agreement was made available on VapiSoft servers for download by the users. New versions or upgrades of the Software may include new License Agreement, which will enter into effect immediately upon user`s agreement to License Agreement. The Privacy Policy of the Software is an integral part of this License Agreement.
The Software is the property of VapiSoft. You may not modify, reverse engineer, decompile, disassemble or create derivative work of the Software.
By using the Software, you agree not to use or rely on the Software or any other Program, information or service whatsoever related thereto for "mission critical" or "content sensitive" applications and use. "Mission critical" applications and use shall mean applications and use that may result in damage if failed; "Content sensitive" shall mean any information or data you do not wish to be freely accessible and generally available to Internet users or advertisers and information that might cause damage once Internet users or advertisers are exposed to it.
Ez-ScreenShot is not free, you can use it free for a limited trial period, and then you will be asked to pay (a low price) for 1 year period. Then you will be asked to pay again.
USAGE OF AND ACCESS TO THE SOFTWARE
As part of the Software, VapiSoft is granting a limited access to the VapiSoft Web site and servers and to servers serving the Software and the VapiSoft Website.
Access to VapiSoft servers is restricted to authorized users who are using Software authorized by VapiSoft.
Access to the Software or parts thereof, granted to you or any other user, can be terminated, limited or denied at any time, temporarily or permanently, with no prior notice.
The VapiSoft servers` functionality may be changed reduced or limited at any time. VapiSoft may elect to grant different grade of service, different levels of access or no access at all and different priorities to different users or to different functions, at any time without prior notice, at its sole discretion.
VapiSoft does not warrant or guarantee that the functions performed by the Software will be uninterrupted or error-free or that defects or bugs in the Software will be corrected, even if VapiSoft has been notified about bugs, errors, inaccuracies or defects in the Software. VapiSoft does not undertake to notify the user about bugs, errors, inaccuracies, and defects in the Software.
The Software functionality may be affected by factors determined by the user`s site, network, communication, firewall, etc. and cannot therefore be guaranteed to function for all users.
WARRANTY
VapiSoft does not guarantee that its recording will be complete, accurate, and that it will not record items that were not suppose to be recorded.
VapiSoft is not responsible for any defects that the software may have caused to the recorded application.
VapiSoft is not responsible for any damages whatsoever, and in particular, VapiSoft shall not be responsible for direct, indirect, special, punitive, incidental, or consequential damages, or damages for lost profits, loss of revenue, loss of use, lost data, lost opportunity, or loss of any other commercial damage, or other damages, arising out of or related to the use, reliance on, inability to use, performance, or non-performance of the information, translation, data or all other services that appears on, or related in any way to the Ez-ScreenShot Software, whether such damages arise from contract, negligence, tort, or otherwise, even if VapiSoft has been advised of the possibility of such damages.
VapiSoft assumes no responsibility for the content or the privacy practices of any program translated by the Software.
VapiSoft maintains the rights to download and renew the HTML page (presentation) in the Ez-ScreenShot main window, by the Ez-ScreenShot.
IF YOU ARE DISSATISFIED WITH THE SOFTWARE, YOUR EXCLUSIVE REMEDY SHALL BE TO CEASE USING THE SOFTWARE.
VapiSoft SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON TRANSLATION CONTAINED IN ITS SOFTWARE.
USAGE OF THE SOFTWARE
By using the Software, you agree comply with legal obligations, including but not limited to, obligations imposed by copyright, secrecy, defamation, decency, privacy and export laws.
The VapiSoft Website and Ez-ScreenShot Software, as most Internet applications, are vulnerable to various security issues and hence, should be considered unsecured. You acknowledge that you are aware that by using the Software, you may be subject to security and privacy exploitations, including, eavesdropping, sniffing, spoofing, hacking, breaking passwords, harassment, exposure to objectionable material, posturing, or other security or privacy hazards, or may reach an erroneous address or recipient.
MISCELLANEOUS
Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such states, the liability of VapiSoft shall be to the smallest extent permitted by law.
This License Agreement shall be governed by and construed with the laws of Israel.
VapiSoft has the right to inform you by email about any upgrades or changes to the application, or any other information it may transmit.
