This End User Licence Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and SoMud with regard to the copyrighted SoMud products, which include computer software, the associated media, any printed materials, and any "online" or electronic documentation. Use of any software and related documentation ("Software") provided to you by SoMud in whatever form or media, will constitute your acceptance of these terms, unless separate terms are provided by the Software supplier, in which case certain additional or different terms may apply. An amendment or addendum to this EULA may accompany the Product.
YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA BY INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE USING THIS PRODUCT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE PRODUCT.
a. This SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. This SOFTWARE PRODUCT is licensed, not sold.
b. The Software is being licensed to you free of charge. Permission is granted to anyone to use this Software for personal (non-commercial) and/or commercial applications, and redistribute it freely, subject to the following conditions:
- You alone are responsible for your own actions using the Software and in ensuring that Your Use of the Software is compliant with all applicable laws and are aware that any Use which is inconsistent with such laws may render you liable to, amongst other things, a fine and/or imprisonment.
- Reverse engineering is not permitted. You agree that you will not attempt, and if you are a corporation, you will use your best efforts to prevent your employees from attempting to reverse compile, modify, translate or disassemble the Software in whole or in part.
- Redistribution of this Software must be in its original form (in whole). The origin of this Software must not be misrepresented; you must not claim that you wrote the Software. If you use this Software in a product or a project (commercial or non-commercial), an acknowledgement in the product or project documentation would be appreciated but is not required.
c. If you distribute the Software in violation of this Agreement, you agree to indemnify, hold harmless and defend SoMud and its suppliers from and against any claims or lawsuits, including attorney`s fees that arise or result from the use or distribution of the Software in violation of this Agreement.
d. The Software may transmit data between you and other users or websites to serve its features. All data and information are transmitted anonymously. No personal information is collected or revealed.
e. SoMud reserves the right, at its sole discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this License Agreement when SoMud upgrades the Software. If any future changes to this License Agreement are unacceptable to you or cause you to no longer be in compliance with this License Agreement, you may not install or use the upgraded Software.
f. THE PROGRAM IS PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Each Recipient is solely responsible for determining the appropriateness of using and distributing the Program and assumes all risks associated with its exercise of rights under this Agreement, including but not limited to the risks and costs of program errors, compliance with applicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption of operations.
