LICENSE AGREEMENT
The Proxy Server Agent License Agreement is a legal agreement between you and ProxyServerAgent.com. Please read it carefully before using the Software. By downloading, copying, installing or otherwise using the Software, you confirm your acceptance with the terms of this License Agreement and agree to be bound by them. If you do not agree to the terms of this License Agreement, do not use the Software and related services in any manner.
1. DEFINITIONS
"Web site" or "We" shall, unless otherwise noted, refer to ProxyServerAgent.com.
"Software", "ProxyServerAgent" means only Proxy Server Agent, any associated components and online or electronic documentation.
"You" means the person agreeing to this agreement.
2. RIGHTS AND LIMITATIONS
Proxy Server Agent is free software (freeware). We grant you a limited, personal, non-commercial, non-exclusive, non-sublicensable, non-assignable, free of charge license to download, install and use Proxy Server Agent on your computer for personal, non-commercial purposes.
You agree that ProxyServerAgent.com may audit your use of the Software for compliance with these terms at any time, upon reasonable notice.
Your license rights under this License Agreement are non-exclusive.
Certain rights may be available only under a separate agreement.
You may not alter, merge, modify, adapt, decompile or disassemble the Software or create derivative works based upon the Software.
You may not sell, rent, lease, or sublicense the Software.
You may use the Software only for personal, non-commercial purposes.
You may not use the Software to crash, slow, harm any computer system; obtain unauthorized access to any computer system; put to inconvenience or threaten anyone; send spam (mass emailing), commercial email solicitation or advertisements.
In the event that you fail to comply with this License Agreement, ProxyServerAgent.com may terminate the license and you must stop using and destroy all copies of the Software and all of its component parts.
3. INTELLECTUAL PROPERTY RIGHTS
This license gives you a limited license to use the Software. ProxyServerAgent.com retains all rights and title, including all copyright and intellectual property rights, in and to, the Software, all its copies, and to the content that is not contained in the Software, but may be accessed through use of the Software. This License Agreement grants you no rights to use such content. All rights not specifically granted in this License Agreement are reserved by ProxyServerAgent.com.
4. NO WARRANTY
PROXYSERVERAGENT.COM HAS MADE NO WARRANTIES TO YOU REGARDING THE SOFTWARE AND THE SOFTWARE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. PROXYSERVERAGENT.COM DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESSED OR IMPLIED, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
PROXYSERVERAGENT.COM IS NOT LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, OF THE SOFTWARE.
PROXYSERVERAGENT.COM DOES NOT WARRANT THAT THE SOFTWARE IS ERROR-FREE AND THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION.
PROXYSERVERAGENT.COM PROVIDES NO TECHNICAL SUPPORT OR WARRANTIES FOR THE SOFTWARE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PROXYSERVERAGENT.COM, ITS DEALERS, DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF ANY WARRANTY PROVIDED HEREIN.
5. LIMITATION OF LIABILITY
IN NO EVENT PROXYSERVERAGENT.COM WILL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY OR OTHER LOSS WHATSOEVER), ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE, THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS LICENSE AGREEMENT, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF PROXYSERVERAGENT.COM, AND EVEN IF PROXYSERVERAGENT.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. TERMINATION
We reserve the right to suspend and/or terminate this License Agreement without prior notice if we believe that you have violated any term of this License Agreement.
In this case, you must destroy all copies of the Software and all of its component parts.
7. LANGUAGE
This agreement, all documents relating to this agreement and all information provided by ProxyServerAgent.com shall be in English.
8. GENERAL
This License Agreement is a legal agreement between you and ProxyServerAgent.com. If any provision of this License Agreement shall be held by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissible, and the remaining provisions of this License Agreement will remain in full force and effect.
