NOTICE TO USER: PLEASE READ THIS CONTRACT CAREFULLY.
BY USING ALL OR ANY PORTION OF THE SOFTWARE YOU ACCEPT
ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU
AGREE THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY
WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU. IF YOU DO
NOT AGREE, DO NOT USE THIS SOFTWARE.
This document is a legal agreement between you, the End User, and
the individual Shlomo Ben Ami, ("the Developer"). By installing or
using Deep Bricks version 1.0 ("the Software Product"), you agree
to abide by the terms in this agreement.
This version of the Software Product is provided free for 15 days
("the Trial Period"), for the purpose of deciding whether you wish
to retain the Software. Should you decide to retain the Software
after the Trial Period, you agree to pay the Author the license
fee of US $9.95. Payment of the license fee allows you to use one copy
of the Software on a single computer. The Software may not be made
available on a network, and you may not use the Software or make it
available for use on more than one computer at the same time. You may
make one copy of the Software solely for the purpose of archival and
backup.
NO WARRANTIES.
THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY
OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING THE
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE. BY USING THE SOFTWARE PRODUCT, YOU AGREE TO ACCEPT
ALL LIABILITY REGARDING IT`S USE OR MISUSE.
LIMITATION OF LIABILITY.
IN NO EVENT SHALL the Developer BE LIABLE FOR ANY DAMAGES
(INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER
PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY
TO USE THE SOFTWARE, EVEN IF the Developer HAS BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT,
UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND
CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE
AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US
THAT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL
OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US
RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
