END-USER LICENSE AGREEMENT FOR Lastinch easy PC texting
IMPORTANT READ CAREFULLY:
This Lastinch End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and Lastinch for the Lastinch easy PC texting identified above, which includes computer software and associated media and printed materials (if any), and may include online or electronic documentation). By installing, copying, or otherwise using the easy PC texting, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this Agreement, you are not authorized to use the easy PC texting. The easy PC texting is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The easy PC texting is licensed, not sold.
1. GRANT OF LICENSE. This EULA grants you the following rights:
Use and Copy. Lastinch grants to you the right to use copies of the easy PC texting only in conjunction with a validly licensed copy of Lastinch easy PC texting.
- Trial Versions (Will be labeled as ‘Trial Version’)
If this Agreement is included with the trial version copy of the Software, you are granted a limited non-exclusive license to use a copy of the enclosed Software for the purpose of evaluation with the intent of purchase for up to thirty (30) days. Thereafter, you may purchase the right to use the appropriate full version of the Software which license terms are specified below, by contacting Lastinch or your retailer. You may not copy the printed materials accompanying the Software if any, or print multiple copies of any user documentation. BY YOUR USE OF THE EVALUATION COPY OF THE SOFTWARE YOU UNDERSTAND AND AGREE THAT AFTER THIRTY DAYS (30) YOU MAY NOT CONTINUE TO ACCESS AND/OR USE THE SOFTWARE OR ANY DATA YOU HAVE ENTERED INTO SUCH SOFTWARE UNLESS YOU PURCHASE THE APPROPRIATE FULL VERSION OF THE SOFTWARE.
- Full Registered Version - Single-User License (Will be labeled as ‘Standard Version’)
If you purchased the full version of the Software with a single-user license, you are granted a limited non-exclusive license to use one (1) copy of the enclosed Software on up to three (3) computers used by one (1) individual (who is an owner, employee or contractor);
- Full Registered Version - Corporate License (Will be labeled as ‘Corporate Version’)
If you purchased the full version of the Software with a Corporate license, you are granted a limited non-exclusive license to use copies of the enclosed Software by any number of individuals (who are your owners, employees or contractors) on any number of computers regardless of location, but owned or under the control of the purchaser;
2. RESTRICTIONS.
--You must maintain all copyright notices on all copies of the easy PC texting.
--You may not distribute copies of the easy PC texting to third parties.
--You may not reverse engineer, decompile, or disassemble the easy PC texting, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
--You may not rent or lease the SOFTWARE PRODUCT.
--You may permanently transfer all of your rights under this EULA only in conjunction with a permanent transfer of your validly licensed copy or copies of easy PC texting.
3. TERMINATION. Your rights under this EULA terminate upon the termination of your easy PC texting EULA, or without prejudice to any other rights, Lastinch may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the easy PC texting.
4. COPYRIGHT. All title and copyrights in and to the easy PC texting and any copies thereof are owned by Lastinch or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the easy PC texting is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content.
5. NO WARRANTY. ANY USE OF THE easy PC texting IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Lastinch AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
6. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLELAW, IN NO EVENT SHALL Lastinch OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE easy PC texting, EVEN IF Lastinch HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
7. LIMITATION OF LIABILITY. Lastinch ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER THIS EULA SHALL NOT EXCEED FIVE DOLLARS (US$5.00).
