eClick DEMO License Agreement
The eClick DEMO is provided to you under license. No sale has occurred. This license agreement defines
the ways in which you may use the eClick DEMO and the grahics it contains or creates.
The eClick DEMO (herein after referred to as SOFTWARE) IS A PROPRIETARY PRODUCT OF KINETIC
CREATIONS, INC. (herein after referred to as "KCI") AND IS PROTECTED BY COPYRIGHT LAWS. USE OF
THIS SOFTWARE IS GOVERNED BY THIS LICENSE AGREEMENT AND APPLICABLE LAW INCLUDING
COPYRIGHT LAW.
Grant of license
KCI grants you a non-exclusive license for the use of the Software as follows. You may either:
a) install the Software on multiple computers, provided that they are owned solely by you, and not
simultaneously.
b) install the Software on a single computer which may be used by different users from time to time, but
not simultaneously.
If the Software is to be used by more than one user under option (a) above or on more than one
computer under option (b) above, you must purchase a number of copies equal to the number of users
under option (a) or the number of Computers under option (b).
Copy restrictions
Ownership of the legal rights contained in the Software remain solely with KCI. These may include trade
secret, trademark, copyright, patent, international treaty and other rights as applicable. You may not
sublicense, rent, lease, decompile, disassemble, create derivative works, or include portions of the
Software in other Software Programs. You may permanently transfer ownership of the Software and
accompanying materials by delivering the original Software media and materials to a third party who
accepts the terms and conditions of this Agreement, and by simultaneously destroying all copies of the
Software and accompanying materials in your possession. Such a transfer terminates your license to
use the Software.
Use of Images
You may modify, publish and distribute the button images in print; create presentations which incorporate
the button images; and use the button images in developing pages for the World Wide Web and Intranet
systems; all provided you are not marketing any of these works as buttons or button images.
Distribution rights
The Software may be freely distributed via electronic bulletin boards, user groups, and person to person.
When distributed, all accompanying files (Read Me,License, etc.), are to be distributed with the Software
WITHOUT EXCEPTION. The Software is not to be included with any commercial software or any public
domain/shareware package sold for profit without proper written consent from Kinetic Creations, Inc..
These rights DO NOT extend to eClick. These rights pertain to the eClick DEMO (SOFTWARE) only.
eClick may NOT be distributed in any form.
Warranty
KCI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE FITNESS OF THE SOFTWARE
FOR ANY PARTICULAR PURPOSE. KCI CLAIMS NO LIABILITY FOR DATA LOSS OR OTHER PROBLEMS
CAUSED DIRECTLY OR INDIRECTLY BY THE SOFTWARE.
