Favorite Notes Software License
The user of this software is granted a non-exclusive license to use
the software program, Favorite Notes (the Software) on one computer
(i.e. a single CPU), for any legal purpose, at a time.
No person or company may charge a fee for the distribution of Favorite
Notes without written permission from the copyright holder.
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SUPPLIED "AS IS", WITHOUT
ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY
WARRANTY OF NON-INFRINGEMENT OR IMPLIED WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL GORILLA BYTES, OR
THE AUTHOR, BE LIABLE FOR ANY DAMAGES WHATSOEVER INCLUDING DIRECT,

HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY ARISING OUT OF
THE USE OF, MISUSE OF, OR INABILITY TO USE THE SOFTWARE, EVEN IF GORILLA
BYTES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
If any of the above provisions are held to be in violation of applicable
law, void, or unenforceable in any jurisdiction, then such provisions
are waived to the extent necessary for this Disclaimer to be otherwise
enforceable in such jurisdiction.
This Disclaimer forms the entire agreement between you and Gorilla Bytes
relating to the software and supersedes all prior or contemporaneous oral
or written communications, proposals and representations with respect to
its subject matter between you and Gorilla Bytes and prevails over any
conflicting, inconsistent or additional terms of any quote, order,
acknowledgment, or similar communication between Gorilla Bytes and you.
You may not sell, emulate, clone, rent, lease, loan, decompile, modify,
disassemble, reverse engineer, or otherwise reduce the software to a
human-perceivable form. You may not distribute or create derivative
works based upon the software in whole or in part. You make one archival
copy of the software. You may not copy, use, or transfer the software,
except as provided for in this agreement. Any such unauthorized use
shall result in immediate and automatic termination of this license and
may result in criminal and/or civil prosecution.
Installing and using Favorite Notes signifies acceptance of these terms
and conditions of the license.
If you do not agree with the terms of this license you must remove
Favorite Notes files from your storage devices and cease to use the
product.
This license is effective until terminated. You may terminate this license
at any time by destroying the media, software, and all copies thereof. This
license will terminate immediately without notice from Gorilla Bytes if you
fail to comply with any provisions of this license. Upon termination, you
must destroy the media, software, and all copies thereof.
If any litigation is brought to enforce this License Agreement, or arises
out of this License Agreement, the prevailing party shall be awarded its
reasonable attorneys fees together with expenses and costs incurred in
such litigation. Venue for any action under this Agreement shall be in
Santa Ana, California. You consent to the personal jurisdiction of the
courts of such venue. This License Agreement is the complete agreement
between Gorilla Bytes and you and supersedes all prior agreements, oral or
written, with respect to the subject matter hereof.
This product includes the 1.4 Java[tm] Runtime Environment, Standard
Edition, from Sun Microsystems.
