This End-User License Agreement (later referred to as the "License Agreement") is a legal agreement between you (either an individual or a single entity) and Getway Recovery Ltd. (Later referred to as "Getway". The Getway Raid Recovery Software later referred to as "Software". By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this License Agreement. If you do not agree to the terms of this License Agreement, do not purchase, install or use the Software.
Copying Restrictions – Licensee`s right to make additional copies of the Software does not extend to any manuals, guidelines, reference material or other documentation. Licensee may NOT copy Getway which have been converted into multi-user Getway which the use of a Server Deployment Pack.
The Software belongs to the Getway. This Software is protected by Copyright Law, International Copyright Treaty and by Revelation`s Defined Licensing Requirements. The Getway License provides one end user use of an application; however, it does not allow the user to change or modify the application. The Getway
license specifically prohibits the ability to create files, create or modify dictionaries, create or delete indexes, as well as any application component (such as reports, forms, programs, etc).
The Software is just authorized to USE only, not to SELL the copyright.
1. Grant of License
Licensee may use this Software. "Use" of the Software means that License has loaded, installed or run the Software on a workstation or sever. DEMO Software is not affected by this restriction.
2. Limitations
- Licensee may not reverse engineer, recompile, and disassembly, modify, translate the Software and make any attempt to discover the source code of the Software.
- Licensee may not transfer, sell, re-sell, offer for sale or distribute the Software. The sale of or distribution of copies of this Software are strictly forbidden. It is a violation of this License Agreement to sell, loan, rent, lease, borrow, or transfer the use of copies of Getway Software.( DEMO Software is not affected by this
restriction).
- Licensee must comply with all the relevant laws of Software using.
3. Termination
The Getway shall automatically terminate without notice if you fail to comply with any terms or conditions License Agreement; upon termination of this Agreement, you shall cease use of the product and, upon request, return to revelation or certify destruction of the product, including documentation and any related materials.
If your Series Numbers or the License Key be found on websites or magazines, Getway has the right to forbid your Series Number or License Key.
4. Copyright
The Software and all associated user manuals and other documentation are the Copyright of Getway. License shall not at any time translate, decode, decompile, or disassemble any portion of the software, or make any derivative works of it, nor permit anyone else to do so.
5. Disclaimer of Warranty
This Software and the Accompanying Files are DISTRIBUTED and SOLD "AS IS" and without warranties as to performance or merchantability or any other warranties whether expressed or implied. Licensee uses the software at his own RISK.
6. Limitation of the Liability
To the maximum extent permitted by applicable, in no event shall revelation or its suppliers be liable for any consequential, incidental, direct, indirect, special, punitive, or other damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other
pecuniary loss) arising out of the use or inability to use the Software, even if the Getway has been advised on the possibility of such damages. In any case, the Getway entire liability under any provision of this License Agreement shall be limited Exclusively to Product Replacement.
7. About the Software Carrier
The Getway Software warrants the physical media and physical documentation provided by Getway Software to be free of defects in materials and workmanship for a period of thirty (30) days from the original purchase date. If Getway Software receives notification within the warranty period of defects in materials or WORKMANSHIP, and determines that such notification is correct, Revelation Software will replace the defective media or documentation. Specifically, Revelation Software makes no representation or warranty that the software or documentation is "error-free" or meets any user`s particular standards, requirements,
or needs. In all events, any implied warranty, representation, condition, or other term is limited to the physical media and documentation and is limited to the 30-day duration of the limited warranty.
8. Applicable Law
This Agreement shall be governed by laws of the Sydney of Canada. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the court of Sydney, Canada, and any competent Courts of Appeal there from. If any provision shall be deemed severable from this license and not affect the validity and enforceability of any other provisions. Any question please contact Getway Recovery LTD.
Attention:
The Demo which offered in the License Agreement is the trial version of Getway. The function of the Demo version is limited, and the installation process, the readme file, or the process itself apparent in English – Demo or the same legal meaning of the word, as well as the text has not been registered or not to include in the License Key, otherwise it is not belonged to the trail version.
