License Agreement
The following License Terms govern your use of the accompanying Software, unless you have a separate signed agreement with Ezer Programmings.
SOFTWARE LICENSE
Notice to all users: carefully read the following legal agreement for the license of specified software ("Software") by Ezer Programmings, Oliver Kaeppeler, Germany ("Ezer Programmings"). If you (either an individual or a single entity) do not agree to all of the terms of this agreement, you are not allowed to use the Software.
1. Software without License File ("Demo Software")
You are welcome to try the Software before you buy it. The Software is fully functional for a while, but you are intermittently reminded that it is not free. If you want to use the software regularly, please purchase a license of it. You will be warned in good time before the evaluation time expires. Using the Software after the evaluation period is in violation to copyright laws.
You are allowed to copy the Software without any License File (Demo Software), provided the copies you make contain all of the Software`s original files.
Trying software before buying it has the ultimate money-back guarantee - if you don`t use the product, you don`t pay for it.
2. Software with License File ("Registered Software")
Subject to the payment of the applicable license fees, and subject to the terms and conditions of this agreement, Ezer Programmings hereby grants to you a non-exclusive right to use the Software for an unlimited duration.
This license authorizes you to make one copy of the License File solely for backup or archival purposes. Of course, you are allowed to copy the Software without any License File (Demo Software), provided the copies you make contain all of the Software`s original files.
2.1 One License
The Software is licensed as a single product; more than one user may not use it on more than one Client Device or at a time. A licensed user is also granted to install the Software with License File (Registered Software) on more than one Client Device, for the sole use of that user.
2.2 Multiple Licenses
You are allowed to make, use and install as many additional copies of the Registered Software on the number of Client Devices as the license authorizes. You must have a reasonable mechanism in place to ensure that the number of Client Devices on which the Registered Software has been installed does not exceed the number of licenses you have obtained.
You also may use the Registered Software on a Client Device as a server within a multi-user or networked environment, on a single physical site. If the number of Client Devices that can connect to the Registered Software can exceed the number of licenses you have obtained, then you must have a reasonable mechanism in place to ensure that your use of the Registered Software does not exceed the use limits specified for the licenses you have obtained.
2.3 Term
This agreement is effective for an unlimited duration. This agreement will terminate automatically if you fail to comply with any of the limitations or other requirements described herein. Upon any termination of this agreement, you have to destroy all License Files. You may terminate this agreement at any time by destroying all License Files.
2.4 Updates
You are entitled to download revisions and upgrades to the Software as and when Ezer Programmings publishes it via its web site.
3. Ownership Rights
Ezer Programmings owns and retains all rights, title and interest in and to the Software, including all copyrights and other intellectual property rights therein. Your possession, installation, or use of the Software does not transfer to you any title to the intellectual property in the Software, and you will not acquire any rights to the Software except as expressly set forth in this agreement.
4. Restrictions
You may not rent, lease or loan the Software. You may not reverse engineer, decompile, or disassemble the Software, except to the extent the foregoing restriction is expressly prohibited by applicable law. You may not modify, or create derivative works based upon, the Software in whole or in part. All rights not expressly set forth hereunder are reserved by Ezer Programmings.
5. Limitation of Liability
Ezer Programmings makes no warranty that the Software will be error-free or free from interruptions or other failures or that the Software will meet all your requirements.
The Demo Software gives users a chance to try the Software before buying it. So you assume responsibility for selecting the Software to achieve your intended results.
Any liability for damage of any sort is hereby denied. In any case, the liability is limited to the registration fee.
