is copyright TMFX Studios (the "Owner") and must not be used,
copied, modified, distributed, transmitted, published or otherwise
reproduced in any form by any means other than strictly in
accordance with the Terms and Conditions set out below.

THE PROGRAM IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND,
EXPRESS OR IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.
THE OWNER WILL PROVIDE NO REMEDY FOR INDIRECT, CONSEQUENTIAL,
PUNITIVE OR INCIDENTAL DAMAGES ARISING FROM IT, INCLUDING SUCH
FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY OR
CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.


USE OF THE PROGRAM:

You are permitted to use the Program as is.
Use of the download program and additional object packs
requires the purchase of the full version.
You may not modify, reverse engineer, decompile or disassemble the
Program.


NON-COMMERCIAL DISTRIBUTION:

Non-commercial distribution (where no charge is made) is
permitted without further authorization so long as the Program
is represented as shareware (and not as free or public domain
software) and so long as all its component files are included
without any modifications or additions (note: non-commercial
distribution includes distribution via free-access websites).


COMMERCIAL DISTRIBUTION:
========================

Commercial distribution of the Program (meaning distribution for
money or other consideration, including giving the Program away
as a "free extra" when another product is sold) is only permitted
if you agree to all the following Terms and Conditions:

[1] You will NOT distribute the Program on CD-ROM, DVD-ROM or in
a retail store (if you want to distribute it in any of these
ways you must obtain explicit prior written permission from
the Owner). Only monthly-magazine cover disks, cover CDs and
cover DVDs are excepted from this rule.

[2] You will only distribute the most current version of the
Program as available from www.tmfxstudios.com (all its files
must be included without any modifications or additions).

[3] You will market the Program as shareware.

[4] You will NOT charge more than the equivalent of 10 US Dollars
including all handling, packaging and delivery charges.

[5] You will NOT rent or lease the Program.

[6] The Owner will retain all copyright to the Program except to
the extent expressly specified in these Terms and Conditions.

[7] Your right to distribute the Program will be non-exclusive
and will not include any right to sublicense or otherwise
cause or permit others to copy or distribute it.

[8] The Owner reserves the right, upon written notice, to
withhold or withdraw permission to distribute the Program
from anyone at any time for any reason.

[9] You will hold the Owner, as well as the Owner`s partners,
contractors, employees and agents, harmless from damage, loss
and expense arising directly or indirectly from your acts and
omissions in copying or distributing the Program.
