GRANT OF LICENSE: Intellicate, Ltd. grants you the following rights provided that you comply with all terms and conditions of this TSDA:
Installation and use: You may install and use the Product according to the terms of the Intellicate, Ltd. TSDA included with the Product.
SCOPE OF DISTRIBUTION: You may distribute the trial or shareware versions of the Product via Website, Magazine, Book, or CD with no further permission from Intellicate, Ltd. Any other methods of distribution must be approved in writing. You must not distribute the Product under any other name or representation.
LIMITATION OF LIABILITY AND REMEDIES: Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of Intellicate, Ltd. and any of its suppliers under any provision of this TSDA and your exclusive remedy for all of the foregoing (except for any remedy of repair or replacement elected by Intellicate, Ltd. with respect to any breach of the Limited Warranty) shall be limited to the greater of the amount actually paid by you for the Product.
