Total Recorder Developer Edition 8.3

This Distribution Agreement (the "Agreement") is an agreement between you, the distributor, and High Criteria, Inc. (HCI). By copying Total Recorder (TR), you are agreeing to be bound by this Agreement.

As the copyright and trademark holder for TR, HCI authorizes to you the copying of the files contained in TR Evaluation Package for your own use or for giving to others, under the following conditions:

1. The TR Evaluation Package may not be modified and must be distributed together, as a complete package. You may not distribute corrupted or otherwise damage files.

2. No price or other compensation may be charged for TR Evaluation Package. Reasonable costs may be charged for media and shipping.

3. Neither the Agreement nor any part or portion hereof shall be assigned or sublicensed. If any provision of this Agreement be held to be void or invalid, the validity and enforceability of the other provisions shall not be affected. If any provision is determined to be unenforceable, you agree to modify such provision to provide for enforcement of the intent, to the extent permitted by applicable law.
Failure of a party to enforce any provision of this Agreement shall not constitute a waiver of such provision or of the right to enforce such provision. If you fail to comply with any terms of this Agreement, your license is automatically terminated, and you may be prosecuted under national and European laws and under International Treaty provisions.

4. You acknowledge that, you have read this Agreement, you understand this agreement, and understand that by copying any part of TR, you agree to be bound by this Agreement`s terms and conditions. You also agree, except for written separate agreements between HCI and you, this Agreement is a complete and exclusive statement of your rights. This agreement supersedes all prior agreements, proposals or understandings, and any other communications between HCI and you relating to this Agreement.
